DRIVER WITH OPEN ALCOHOL REFUSES ROAD-SIDE BREATH TEST

GRAVENHURST — A driver with open alcohol in his vehicle who refused to take a police breathalyser road test was charged early Saturday evening.

Police says that on May 23, just before 6:30 p.m., Bracebridge OPP officers responded to a concern from a member of the public about a motorist who may be driving under the influence of alcohol.

Officers located the vehicle and conducted an investigation and subsequently arrested and charged 31-year-old Joshua Rolston, of Gravenhurst, with Refusal to Comply with Demand to Provide a Sample of Breath CC 320.15(1) and Drive Motor Vehicle with Open Container of Liquor LLA 32(1).

He is to appear in the Ontario Court of Justice in Bracebridge on Aug. 4, 2020.

Police say refusing an officer’s demand to provide a sample of breath carries the same roadside consequence as other impaired related charges and therefore the driver’s vehicle was impounded and his driver’s licence was suspended for 90 days.
