2 DRIVERS CHARGED WITH IMPAIRED IN SAME VEHICLE

HUNTSVILLE A police pursuit Saturday night has led to two drivers in the same vehicle being charged with impaired driivng

Provicial police here say that

Saturday April 18th, 2020 at approximately 8:30 p.m. an Officer of the Huntsville Ontario Provincial Police (OPP) observed a car travelling on West Road, Huntsville at an excessive rate of speed. The officer attempted to stop the car at which time the car fled in an effort to evade the police.

Other members of the OPP joined in the search for the car which was located and stopped a short time later in the Maple Heights Drive and Brunel Road area.

An investigation determined that during the time the car was first observed and while the car was fleeing the police pursuit the driver allegedly switched with a passenger in the car.

Further investigation resulted in the following charges against the following two males.

Anthony Toenz, 28, of Bolton:

  • Dangerous operation of a motor vehicle contrary to section 320.13 of the Criminal Code.
  • Operating a motor vehicle while impaired by alcohol contrary to section 320.14(1)(a) of the Criminal Code.
  • Operating a motor vehicle with blood alcohol concentration above 80 mg. contrary to section 320.14(1)(b).
  • Flight from police contrary to section 320.17 of the Criminal Code
  • Stunt driving contrary to section 172(1) of the Highway Traffic Act.
  • Drive motor vehicle not equipped with an approved interlock device contrary to section 41.2(13) of the Highway Traffic Act.

Nicholas Pratt, 28, of Caledon:

  • Operating a motor vehicle while impaired by alcohol contrary to section 320.14(1)(a) of the Criminal Code.
  • Operating a motor vehicle with blood alcohol concentration above 80 mg.
  • contrary to section 320.14(1)(b).

Toenz and Pratt were both released on an Appearance Notice to appear in the Ontario Court of Justice, Huntsville July 8.

As in all cases where a driver has been charged with impaired driving, the driver’s licences of Toenz and Pratt have been suspended for 90 days and their car was impounded.

Huntsville OPP remains committed to ensuring Ontario roads are safe from alcohol-impaired and drug-impaired drivers. The OPP is reminding drivers that no amount of alcohol or drugs in your system is safe when operating a motor vehicle.

Huntsville OPP chased a vehicle in which they said the the driver and passenger switched seats before being stopped.
